Terms of Service
The rules for using QSmart

These Terms govern your use of QSmart (the "Service"), operated by BE YOU 4 U LTD (Company Number 14842501), 128 City Road, London, EC1V 2NX, United Kingdom ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. The Service
QSmart is a queue and appointment management platform. Businesses create queues; their customers join those queues from their own device. We provide the Service on an "as is" and "as available" basis and may change or improve features over time.
2. Accounts
- You must provide accurate information and keep your login credentials secure.
- You are responsible for all activity under your account.
- You must be at least 16 years old to create an account.
- Customers may join a queue as a guest without creating an account.
3. Acceptable use
You agree not to:
- Use the Service unlawfully, or to harass, defraud or mislead anyone;
- Upload malicious code, probe, scan or attempt to breach the Service or its security;
- Interfere with other users, overload the Service, or scrape it by automated means without permission;
- Misuse customer personal data collected through the Service.
We may suspend or terminate accounts that breach these Terms.
4. Plans, fees and payment
- Paid plans and their limits are described on our pricing page.
- Payments are processed by Stripe; we do not store full card details.
- Subscriptions renew automatically unless cancelled before the renewal date.
- We may change prices with reasonable notice; changes do not affect the period already paid for.
- Free plans may be limited, changed or withdrawn.
5. Your responsibilities as a business
If you use QSmart to manage customers, you are the data controller for the customer information you collect through it. You must have a lawful basis for processing that data, tell your customers how you use it, and comply with applicable data-protection law. 6. Availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may carry out maintenance, and may suspend the Service where necessary for security or legal reasons.
7. Intellectual property
The Service, its software, branding and content remain our property or that of our licensors. You keep ownership of the content and data you put into the Service, and grant us the licence needed to operate the Service for you.
8. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Subject to that, we are not liable for indirect or consequential loss, loss of profit, business or data; and our total liability in any 12-month period is limited to the fees you paid us in that period (or £100 if you use a free plan).
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or where required by law. On termination, we will delete or anonymise your data as described in our Privacy Policy, subject to legal retention duties.
10. Changes to these Terms
We may update these Terms. Material changes will be reflected by the "Last updated" date above and, where appropriate, notified to you. Continuing to use the Service means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
